Terms & Conditions of Entry

The following terms and conditions apply for Ottway the Label and Surf Spirit CmbH & Co. KG

1. Responsibility to Review Terms
   Entrants and participants in the Competition are responsible for familiarising themselves with these Terms and Conditions at the time of participation. The Promoter’s decision not to enforce its rights or any specific restriction (whether communicated to an entrant or not) does not constitute a waiver of those rights, restrictions, or of the Terms and Conditions generally.

2. Entry Compliance
   Entries not complying with these Terms and Conditions are ineligible. The Promoter reserves the right to disqualify any entrant and cancel any prize awarded to an ineligible entrant if it is later discovered that the winner was ineligible.

3. Promoter Decisions
   The Promoter’s (or an associate of the Promoter’s) decision in relation to any aspect of these Terms and Conditions is final and binding on every person who enters. No correspondence will be entered into.

4. Modification of Entry Information
   Requests to modify any information provided should be directed to the Promoter.

5. Prize Transferability
   The Prize is not transferable or exchangeable and cannot be redeemed for cash.

6. Prize Substitution
   If the Prize or any element of the Prize becomes unavailable for reasons beyond the Promoter’s control, a similar prize of equal or greater value may be awarded in lieu, subject to approval by the relevant regulatory authorities (if required). At the Promoter’s absolute discretion, cash may be substituted for any prize.

7. Prize Delivery and Responsibility
   Prizes will be delivered electronically and will not be replaced if lost or stolen. All taxes (excluding GST), which may be payable as a consequence of receiving the prize, are the sole responsibility of the winner.

9. Use of Winner’s Name and Image
   Entrants consent to the use of their name, likeness, or image by the Promoter if they are the winner of the Prize, for an unlimited period without remuneration. Entrants agree to comply with any reasonable direction of the Promoter in this regard.

10. Competition Delays or Disruptions
    If any aspect of this Competition is delayed or cannot run as planned due to circumstances beyond the reasonable control of the Promoter (including war, terrorism, disaster, computer virus, network failure, tampering, fraud, or technical failures), the Promoter may cancel, terminate, modify, or suspend the Competition, or invalidate affected entries, subject to regulatory approval if required.

11. Verification and Disqualification
    The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including identity, age, and place of residence) and may disqualify any individual who has breached any Terms and Conditions, tampered with the entry process, or engaged in unlawful or improper conduct jeopardising the fair conduct of the Competition.

12. Competition Amendments
    The Promoter reserves the right to cancel or amend the Competition and these Terms and Conditions. Any changes will be communicated to participants where reasonable or made publicly available.

13. Invalid Entries
    Entries that are rude, defamatory, offensive, illegal, incomprehensible, incorrect, incomplete, or breach any law or third-party rights (including intellectual property rights) will be invalid and may be removed by the Promoter.

14. Liability
    Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees, and agents) excludes all liability (including negligence) for any personal injury or any loss or damage (including indirect, special, or consequential loss or loss of profits) in connection with this Competition or the use of the Prize. Where liability cannot be excluded by law, it is limited to the minimum allowable by law.

15. Use of Personal Information
    By entering, entrants consent to the storage of their personal information on the Promoter’s databases and its related bodies corporate. This information may be used for future promotional and marketing purposes, including contacting entrants via the details provided. At an entrant’s request, all information provided will be removed from the databases.

16. Winner Notification
    Winners will be contacted via newsletter within one (1) business day. The Promoter is not responsible for unread, undelivered, or incorrect contact details. An email address must be provided for the winner’s details to be added to the attendee database.

17. Travel and Additional Costs
    Travel, flights, visas, transfers, bar tabs, and extra activities are not included.

18. Surf Spirit Prize Conditions 

• Surf Spirit prize 2x1 week surf and yoga retreat (2 x independent winners). Winner must contact Surf Spirit by 31 December 2025.

• Prize must be redeemed by 26 October 2026.

• No legal recourse is available.
  

• The prize is limited to the services included in the surf and yoga package and all extras are excluded.

• The location can be chosen between Jungle Villa  Sri Lanka or Beach Lodge Sri Lanka.

• Prize redemption depends on availability.

19. Ottway The Label Voucher
    The Ottway The Label voucher is valid for one year, expiring December 2026.
